Terms of Service
These terms are an agreement between WattleKin (we, us) and the organisation that signs up for Wattlekin (you). The person who creates the account confirms they are authorised to accept these terms for that organisation. Please read them with our Privacy Policy, which forms part of these terms.
1. The service
Wattlekin is online software for NDIS providers. It helps you manage rosters, support workers, participants, timesheets and pay, and connect to services such as Xero. We may improve, change or retire features over time. If we remove something you rely on, we will tell you in advance where we reasonably can.
We work hard to keep Wattlekin available, but it may sometimes be unavailable, for example during maintenance or because of problems with services we rely on. We do not promise uninterrupted or error-free service.
2. Your account and your users
- Wattlekin is for businesses and organisations, not personal use. You need a business email address to sign up.
- Your super admins decide who can use your account and what they can see. You are responsible for everyone you give access to, and for what they do in your account.
- Keep sign-in details private and tell us straight away at hello@wattlekin.com.au if you think someone has accessed your account without permission.
- Give us accurate details and keep them up to date.
3. Your data
Your data belongs to you. This includes everything you or your users put into Wattlekin, such as details of staff, participants, shifts, timesheets and pay.
You give us permission to store, copy and process your data only as needed to provide, secure, support and improve Wattlekin for you, and as required by law. We do not sell your data and we do not use it for advertising.
You are responsible for your data and for having the right to use it in Wattlekin. This includes telling participants, their representatives and your staff how their information is handled, getting any consent you need, and meeting your own obligations under privacy law, the NDIS Practice Standards and the NDIS Code of Conduct.
Each organisation's data is kept separate from every other organisation's.
4. Tools that help, not advice
Wattlekin includes tools that check rosters against SCHADS Award rules, use NDIS support items and prices, and work out hours and pay. These are there to help you. They are not legal, payroll, tax or financial advice, and rules and prices change.
You remain responsible for your decisions, including checking rosters, pay, award compliance, tax, superannuation and NDIS claims before you rely on them.
5. Acceptable use
You must not, and must not let anyone else:
- use Wattlekin for anything unlawful, harmful or fraudulent;
- try to access another organisation's data, or parts of Wattlekin you are not allowed to use;
- interfere with or disrupt Wattlekin, its security or the people using it;
- copy or resell Wattlekin;
- send spam through Wattlekin.
6. Plans and payment
- Plans are monthly and priced by how many support workers are active at the same time. Inactive and deleted staff do not count. You will see the price of a plan in Wattlekin before you subscribe.
- Prices are in Australian dollars. If GST applies, it is shown on your invoice.
- Plans are paid monthly in advance by card through our payment provider, Stripe, and renew automatically each month until cancelled. We do not store your full card details.
- Moving to a bigger plan starts straight away. You pay the difference for the rest of the current month.
- Moving to a smaller plan starts from your next bill. Your active support workers must fit within the smaller plan first.
- If a payment fails, we will try again and let you know. If it still cannot be paid, we may limit your account until payment is made.
- We may change our prices. We will give you at least 30 days' notice before a change applies to you, and you can cancel before then.
- Except where the law requires otherwise, payments are not refundable, including for part months.
7. Cancelling
A super admin can cancel at any time in Wattlekin under Settings, Plan and billing. There is no lock-in contract and no cancellation fee.
When you cancel, you keep full use of your plan until the end of the month you have paid for. After that, support workers are made inactive and can no longer use the worker app. Office users can still sign in, and if you renew, your support workers are made active again.
We keep your data for at least 90 days after your plan ends, so you can renew without losing anything. After that, we may delete it. You can ask us for a copy of your data, or ask us to delete it sooner, by emailing hello@wattlekin.com.au.
We may suspend or close an account that seriously or repeatedly breaks these terms, or that has not paid. Where reasonable, we will give notice and a chance to fix the problem first.
8. Security and confidentiality
We take reasonable steps to protect your data, including encryption in transit, access controls and keeping each organisation's data separate. Your data is stored in Australia. More detail is in our Privacy Policy.
If we become aware of a data breach that affects your data, we will tell you without undue delay and give you the information we reasonably can, so you can meet your own obligations, including under the Notifiable Data Breaches scheme.
We each keep the other's confidential information private and use it only for the purposes of this agreement, unless the law requires otherwise.
9. Other services
Some features connect to services run by others, such as Xero, Stripe and Google Maps. When you choose to use them, their own terms also apply, and we are not responsible for those services.
10. Our intellectual property
We own Wattlekin, including its software, design and name. You may use it for your organisation while your plan is active. If you send us ideas or feedback, we may use them freely.
11. Australian Consumer Law and liability
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
To the extent the law allows:
- our liability for a failure to meet a guarantee that cannot be excluded is limited to supplying the service again or paying the cost of having it supplied again;
- our total liability to you for anything else relating to Wattlekin is limited to the fees you paid us in the 12 months before the event that caused the claim;
- we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill.
These limits do not apply to liability that cannot be limited by law, or to loss caused by our fraud or wilful misconduct.
You are responsible for claims made against us by others because of your data, or because you or your users broke these terms or the law, except to the extent we caused the loss.
12. Changes to these terms
We may update these terms from time to time. If a change is significant, we will tell you by email or in Wattlekin at least 30 days before it applies. If you keep using Wattlekin after that, the new terms apply. If you do not agree, you can cancel before then.
13. General
- These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.
- If any part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- We may send you notices by email to your super admins or in Wattlekin. You can send notices to us at hello@wattlekin.com.au.
- These terms and our Privacy Policy are the whole agreement between us about Wattlekin.
